Privacy Policy

All IP Operating, LLC d/b/a NotaryAct values your privacy in your personal information and your Records that you store in our Service. This Privacy Policy explains what information NotaryAct collects about you and why, what we may do with that information and how we handle your Records.

The Scope of This Privacy Policy

This Privacy Policy is incorporated into the NotaryAct Terms of Use, and applies to the information obtained by us through your use of this Site, the Application and the Service. Capitalized terms used in this Privacy Policy and not otherwise defined shall have the meanings provided for those terms in the Terms of Use.

Privacy Policy Changes

As NotaryAct evolves, we may need to update this Privacy Policy to keep pace with changes in the Service and laws applicable to us and you. If we make any material changes we will notify you by email or by means of a notice on this Site prior to the change becoming effective. If you disagree with any changes in this Privacy Policy and do not wish your information to be subject to the revised Privacy Policy, you will need to close your account before the new Privacy Policy becomes effective.

Information Collection and Use

We collect very little personal information about our users. The list of the “Personal Information” NotaryAct may collect, and why we collect it, includes your name, mailing address, phone number, email address, password, the State(s) where you are a commissioned notary and your commission number and expiration date of your commission.
We collect this information for purposes of providing a user account and storing Records made through NotaryAct. This lets us create your account, provide you with convenient and personalized access to your Records, and deliver and support the Service. This information also helps us communicate with you about your use of the Service, product announcements and updates, as well as respond to your requests for assistance (including providing account verification support if you’re having difficultly accessing your account). In addition, we may use your Personal Information to send you marketing emails and special offers about the Service.
We collect the geographic area where you use your computer and mobile devices (as indicated by an IP address or similar identifier). We collect this information in order to help us deliver and support the Service
We collect any Records you add to your account. We don’t use this information for any purpose other than to make sure it is available to you when you use the Service.
NotaryAct’s Site and Application also collect and receive information from your computer or mobile device, including the activities you perform within your account, the software you are using (for example, your operating system or browser), and information obtained from cookies (a small text file that is stored on a user’s computer for record-keeping purposes). When you access NotaryAct via the Application, the Application will request access to certain information on your computing device.
We automatically collect information on the type of device you use and the device identifier (or “UDID”). We collect your location based information for the purpose of locating an address so that a user’s location can be recorded. We will only share this information with our mapping provider for the sole purpose of providing you this service. Geo location data can be attached to your Records and the geo data will be retained with your Records. If you do not want us to track your geo-location information in the Application you may turn this off at the device level. Our app allows the Notary to upload an image of themselves to use as an avatar. The user grants explicit camera rights to take such image, and this is an optional feature for the app. The image can be taken directly from the app or access from the camera roll. The user can remove this image at any time and this image is not shared with any 3rd parties or used for any other purposed by us.
In addition, we automatically gather information that indicates your association with one of our business partners or certain promotions. We use this information to determine the amount of revenue share payments to make to partners with whom we might have such arrangements.

Personal and Sensitive User Data

NotaryAct does collect personally identifiable information in the form of images of the signer of signer’s government issues identification who appear before the user of our service. The information is collected for the sole purpose of the user maintaining a journal of notarial acts. The images collected are not shared with any third parties and can only be accessed by the user when logged into their password protected journal of notarial acts.

Information Access and Disclosure

NotaryAct is not in the business of selling or renting user information, and we only disclose information when:

  • We have your explicit consent to share the information;
  • We are required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, law enforcement officers or other legal process;
  • We have a good faith belief that such disclosure is reasonably necessary to: enforce our Terms of Use; respond to claims that any posting or other Records violates the rights of third-parties; or protect the rights, property, or personal safety of NotaryAct.com, its users, or the general public;
  • We need to share your information with affiliated and unaffiliated service providers who process data on our behalf and subject to strict data protection requirements;
  • We use the information in aggregate reports for performance tuning, analytics and research; or
  • We need to do so in connection with the sale or reorganization of all or part of our business, as permitted by applicable law.

NotaryAct has no direct relationship with individuals appearing before users of the Service and any such individuals who seek access, or who seeks to correct, amend, or delete Records should direct their query to the applicable User. If the User requests NotaryAct to annotate the Records, we will respond to their request within 30 business days.
NotaryAct will retain Records we process on behalf of our users for as long as needed to provide services to our users or for as long as your account is active and as needed to provide you services. NotaryAct will retain and use this Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
As a rule, NotaryAct employees do not monitor or view your Personal Information or Records stored in the Service, but it may be viewed if we believe the Terms of Use have been violated and confirmation is required, if we need to do so in order to respond to your requests for user support, or we otherwise determine that we have an obligation to review it as described in our Terms of Use. Your Records also may be viewed where necessary to protect the rights, property or personal safety of NotaryAct and its users, or in order to comply with our legal obligations, such as responding to warrants, court orders or other legal process.

Data Storage and Transfer

Data Storage

When you use NotaryAct Software on your computing device, Records that you create will temporarily be stored locally. When you synch your computing device with the Service, the Records will be transmitted to our servers, which are located in the United States.
Please be aware that Personal Information and Records submitted to NotaryAct will be transferred to a data center in the United States. If you post information to the Site you are confirming your consent to such information, including Personal Information and Records, being hosted and accessed in the United States.

A Special Note to International Users

NotaryAct welcomes international users to browse the Site and use the Service. International users consent to all the Terms of Use and this Privacy Policy. International users waive any and all remedies that they may have based on the laws of their country.

Security of User Data

NotaryAct is committed to protecting the security of your information and takes reasonable precautions to protect it. However, Internet data transmissions, whether wired or wireless, cannot be guaranteed to be 100% secure, and as a result, we cannot ensure the security of information you transmit to us; accordingly, you acknowledge that you do so at your own risk. Once we receive your data transmission, we make all commercially reasonable efforts to ensure its security on our systems:
Your NotaryAct password is protected by encryption, and only you have access to it.
Your Personal Information and Records stored in our systems is protected by various physical, electronic and procedural safeguards. We regularly evaluate our technologies, facilities, procedures and potential risks to maintain the security and privacy of our users’ Personal Information and Records.
When you enter sensitive information and Records on our Service, we encrypt the transmission of that information using secure socket layer technology (SSL). We follow generally accepted standards to protect the Personal Information submitted to us, both during transmission and once we receive it. NotaryAct utilizes secure hypertext protocol (HTTPS) designed to transfer encrypted information between mobile devices and computers over the internet.
If NotaryAct learns of a security system breach, we may attempt to notify you and provide information on protective steps, if available, through the email address that you have provided to us or by posting a notice on our Site. Depending on where you live, you may have a legal right to receive such notices in writing.

Information Control

If you stop using NotaryAct the Records you have saved on our Service will remain available to you for a period of one (1) year. During that time you will have the ability to copy, print, or download reports of your Records. Thereafter it may no longer be accessible to you or others who may access the Service, but residual copies of your Records may continue to exist on NotaryAct’s back-up and archiving systems.
If NotaryAct closes your account due to a Terms of Use violation, then the Records you have saved on our Service will remain available to you for a period of one (1) year. During that time you will have the ability to copy, print, or download reports of your Records. Thereafter it may no longer be accessible to you or others who may access the Service, but residual copies of your Records may continue to exist on NotaryAct’s back-up and archiving systems.
