Nebraska’s Journal Framework

Nebraska is one of only a handful of states where the Secretary of State’s own FAQ explicitly confirms that journals are optional under state law. This clarity is useful — there is no ambiguity about whether “recommended” means “required.” For traditional notarizations, the only required supply is the ink stamp seal.

Nebraska has two distinct technology-based notarization tracks: eNotary (IPEN — in-person electronic notarization, signer physically present) and Online Notary (RON — remote signer). Each has separate registration requirements and recordkeeping rules. The Online Notary track has the more detailed mandatory records requirement under the Online Notary Public Act.

The RON A/V recording restriction is Nebraska-unique: the recording must capture the identity verification process but must NOT include images of the documents themselves. This differs from most RON states where the full session recording — including document views — is retained.

Online RON Required Record Contents (Neb. Rev. Stat. § 64-409)

For each online notarial act, the mandatory electronic record must include: the date and time; the type of notarial act; the title or type and date of the document; the printed name and address of each principal; the identity verification method used; the A/V recording (without document images) and identity verification recording; and the fee charged. A backup of the electronic record is required.
